Scope

This Privacy Policy explains how YOKOWO CO., LTD., YOKOWO AMERICA CORPORATION, YOKOWO MANUFACTURING OF AMERICA LLC and other affiliates of YOKOWO CO., LTD. (collectively, "we," "our," or "us") collect, use, disclose, and otherwise process personal information about individual residents of the State of California ("consumers" or "you"), either online or offline, within the scope of the California Consumer Privacy Act of 2018 ("CCPA") .

Unless otherwise expressly stated, all terms in this Privacy Policy have the same meaning as defined in the CCPA.

What is personal information?

When we use the term "personal information", we mean information that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular consumer or California household.

Our Collection and Use of Personal Information

We collect, use and disclose consumers' personal information for our everyday business purposes, including processing and fulfilling orders; human resources-related functions relating to our employees; maintenance of the safety, security, and integrity of our websites; compliance with legal and regulatory obligations, and more.

We collect some of this information from you directly, such as when you contact us by phone, email or webform; or when you purchase our products and provide us with information necessary to fulfil the transaction; or when you apply for a job with us or in the capacity of your employment with us. You may always choose not to provide us with this information, but if you choose not to, you may not be able to access certain of the features or products we offer.

In addition to any information which you provide to us directly, we use a variety of technologies (such as cookies) that may automatically or passively collect and store information about your online interactions whenever you visit and interact with our website. We treat such usage information as personal information to the extent required by the CCPA.

In certain circumstances, we may also receive certain personal information about you from third parties, including our e-commerce partner vendors and service providers who are working on our behalf. Such third-party information enhances our ability to best serve you.

What Categories of Personal Information Do We Collect?

Set forth below are the categories of personal information that we have collected from our consumers in the preceding twelve (12) months, as well as the sources from which we have collected such information, and the purposes governing its collection and sale (where applicable). Please note, however, that the types of personal information we collect, and the manner in which we collect them, depend largely on the nature of your relationship with us. Therefore, not all of the categories below may apply to you. If you wish to obtain further details about the personal information which we collect about you personally, you may exercise your "right to know", which is described in the section of this Privacy Policy entitled "Your California Privacy Rights."

  • Conducting website analytics in order to improve website performance and for general marketing purposes.
  • Improving our products and enhancing our services.
  • Performing regular business functions, such as maintaining consumer accounts, providing customer service support, processing or fulfilling orders and transactions, issuing quotations, invoices and purchase orders, verifying consumer information, record-keeping and backup-related functions, and contracting with service providers to assist in these functions.
Business Purposes as an Employer
  • Conducting hiring activities.
  • Processing our employees' personal information for record-keeping purposes, to apply for working visas, in the context of whistleblowing investigations, for administrative, accounting, and other HR functions, and contracting with service providers to assist in these functions.
Personal information categories listed in the California Customer Records (Cal. Civ. Code § 1798.80(e)), such as credit card number, bank account information or other financial information, SSN, signature, passport number, nationality, professional/employment-related information, and certain of the "identifiers" listed above (name, telephone number, address, etc.).

  • Performing regular business functions, such as maintaining consumer accounts, providing customer service support, processing payment information, fulfilling orders and transactions, issuing quotations, invoices and purchase orders, verifying consumer information, and contracting with service providers to assist in these functions.
Business Purposes as an Employer
  • Conducting hiring activities.
  • Processing our employees' personal information for record-keeping purposes, to apply for working visas, in the context of whistleblowing investigations, for payroll and benefits-processing, for administrative, tax, accounting and other HR functions, and contracting with service providers to assist in these functions.

Internet/Network Information, such as IP address, unique online identifier, browsing and search history on our website (including the pages viewed, time and duration of views), etc.
  • Automated collection when the consumer emails us or submits a webform, interacts with our website through the use of first-party and third-party cookies, applies for a job on our website, or during employees' online interactions at work.
Commercial Purposes
  • Tracking consumers' online interactions for advertising purposes.
Business Purposes
  • Detecting and protecting against security incidents and fraudulent or illegal activities.

  • Performing regular business and administrative functions including online job application receipt/record-keeping, online data security and internet browsing activity monitoring/firewalls to detect against security incidents and inappropriate or illegal activities, and contracting with service providers to assist in these functions.

  • Performing regular business functions, approving new business accounts, and contracting with service providers to assist in these functions.

  • Conducting hiring activities, including reviewing and interviewing job applicants and processing job applications, processing internal transfer applications, record-keeping, etc., issuing quotations, and contracting with service providers to assist in these functions.
Non-Public Education Information (20 U.S.C. § 1232g, 34 C.F.R. Part 99), such as educational institutions attended, degrees received, educational distinctions, etc.

Disclosure and Sale of Personal Information

In the last twelve (12) months, we have not sold personal information about you, but we have, at times, disclosed certain categories of personal information to third parties for business purposes.

We employ third party service providers to perform functions on our behalf that, from time to time, require us to disclose your information for our own business purposes. In some instances, we may also be required to disclose your personal information to comply with a legal obligation or governmental request, to detect and prevent fraud, to verify or enforce our Terms of use / Notice of Terms and Conditions, and more. Further details about the "business purposes" for which we may disclose personal information are set forth in the table below.

Minors Under Age 16

Our website is not directed to, and we do not intentionally or knowingly collect the personal information of consumers less than 16 years of age. Furthermore, we do not and will not "sell" the personal information of consumers we know to be less than 16 years of age. However, we do collect some personal information pertaining to minors from our employees, for purposes such as the calculation and distribution of employment benefits and tax deductions for dependents.

As a California resident, you may be able to exercise the following rights in relation to the personal information that we have collected about you (subject to certain limitations at law):

The Right to Know You have the right to request any or all of the following information relating to the personal information we have collected about you or disclosed in the last twelve (12) months, upon verification of your identity:

  • The categories of personal information that we have disclosed about you to third parties for a business purpose, and the categories of recipients to whom this information was disclosed;
  • The categories of personal information we have sold about you (if any), and the categories of third parties to whom this information was sold; and
  • The business or commercial purposes for collecting or, if applicable, selling personal information about you.
The Right to Request Deletion You have the right to request the deletion of personal information that we have collected from you, subject to certain exceptions.
The Right to Opt-Out of personal information Sales

You have the right to direct us not to sell personal information we have collected about you to third parties now or in the future.

 

If you are under the age of 16, you have the right to opt in, or to have a parent or guardian opt in on your behalf, to such sales.

The Right to Non-Discrimination

You have the right not to receive discriminatory treatment for exercising any of the rights described above.

 

However, please note that if your exercise of the rights described above limits our ability to process personal information (such as in the case of a deletion request), fulfilment of that right may mean that we are no longer able to provide you with our products or services or engage with you in the same manner.

How We Verify Your Request

We cannot fulfill your request or provide you with your personal information if we cannot verify your identity or authority to make the request and confirm the personal information relates to you. Making a verifiable consumer request does not require you to create an account with us.

To verify your identity, we will ask that you provide the following personal information when you submit your request:

We maintain records of all our personal data processing activities in accordance with our obligations under Article 30 GDPR. In these records, we reflect all of the information necessary to comply with the GDPR, including where we might act as a data controller and/or as a data processor.
We will cooperate with the supervisory authorities as required pursuant to Article 31 GDPR.

You may need to provide additional information as part of your responses to our identity verification questions. We will only use this information to confirm your identity. Depending on your type of request or the information requested by you, we may require additional information in order to verify your identity and fulfill your request.

If we cannot successfully verify your identity, we will inform you of that fact.

We will respond to your request within forty-five (45) days. However, in certain circumstances, we may require additional time to process your request, as permitted by the CCPA or other applicable law. We will advise you within forty-five (45) days after receiving your request if such an extension is necessary and why it is needed. Any disclosures we provide will only cover the 12-month period preceding our receipt of your verifiable consumer request.

If we cannot fulfill your request, our response to you will also explain the reason why we cannot fulfill your request.

We do not charge a fee to process or respond to your verifiable consumer request unless it is excessive, repetitive, or manifestly unfounded. If we determine that the request warrants a fee, we will tell you why we made that decision and provide you with a cost estimate before completing your request.

You may only make a verifiable consumer request to know about or access your personal information twice within a 12-month period.

How To Exercise Your Right to Opt-Out of Personal Information Sales

As explained above, we do not currently sell your personal information to third parties. However, if at any point we begin selling personal information to third parties for monetary or other valuable consideration (a change which will be reflected in this Privacy Policy), then you have a right to opt-out of such sales. Unless you exercise this right to opt-out, the third parties to whom we may, in the future, sell personal information may then use such information for their own purposes in accordance with their own privacy policies, which might include further reselling this information to additional third parties.

Authorized Agent

In certain circumstances, you are permitted to use an authorized agent to submit requests on your behalf where you provide sufficient evidence to demonstrate that the requestor is an authorized agent, by directly confirming that with us and/or by providing us with your signed written permission (which you may do using the template affidavit referenced below). We may also require you to successfully verify your own identity with us. Alternatively, you may provide us with a power of attorney pursuant to California Probate Code sections 4121 to 4130.

Updates to This Privacy Policy

We will update this Privacy Policy from time to time. If we make material changes to this Privacy Policy, we will provide you with notice to the extent required by law. All changes shall be effective from the date of publication unless otherwise provided in the notification.
